Surrogacy is an alternative method one can utilize to build a family. The laws that enable couples to use surrogacy vary from state to state. Often times couples will travel to another state to avail themselves of favorable surrogacy laws.
The most “vanilla” type of surrogacy is using a gestational carrier also known as a “GC” in the surrogacy world. A gestational carrier is impregnated with the embryo of the genetic Intended Parents. The Intended Parents will undergo In vitro Fertilization in an effort to create healthy embryos. Once these embryos are ready to be implanted into a womb they will be transferred into the uterus of the Gestational Carrier who will carry the baby on behalf of the Intended Parents for a fee. In order to do this the Intended Parents must enter into a contract in a surrogate friendly state with a Gestational Carrier. There are several reproductive lawyers in these states that can assist in drafting these contracts. Once the baby is born the Gestational Carrier will legally have no maternal connection to the baby. In some states the genetic Intended Parents may even petition the courts in advance of the birth of the baby to be the mother and father named on the birth certificate. In other states the Intended Parents may have to go through the process of a step-parent adoption. Consulting other couples who have been though the process of using a gestational carrier may be an informative first step in deciding if this is the right choice for you. In addition there are several IVF clinics, surrogacy agencies, and reproductive attorneys that can further assist you in the endeavor.
Another variation of Gestational Carrier entails the use of an egg donor and/or sperm donor with the gestational carrier. Depending on the exact circumstances, the intended parents may not haveĀ a genetic link to the baby. The extra step in screening an egg donor and/or sperm donor is also added to the emotional equation. Further legal and financial effort will be required if a couple needs an egg donor and/or sperm donor. Again, the gestational carrier in this case will not have a genetic link to the baby however the Intended Parents may not have this component either depending on what type of donation is necessary. IVF clinics and reproductive lawyers will be able to guide you though this process.
Traditional Surrogacy is the most uncommon and unfavorable type of surrogacy. A surrogate mother will get paid to be impregnated with donor sperm and/or the sperm of the Intended Father. The traditional surrogate will be using her own egg in this instance and therefore will have a genetic link to the baby. In many cases this is not a preferred method of surrogacy even if legally agreed to because of the extreme emotional component to it on the side of the surrogate mother.
